These Terms of Service ("Terms") govern your use of the Daily Planner mobile application (the "App") published by Hospitality is Life LLC, operating as LMR Studios ("we," "us," or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

 

## 1. License to use the App

 

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial use, subject to these Terms and the app store's terms.

 

## 2. Your content

 

Anything you enter in the App (shifts, contacts, notes, and other entries) is yours. It is stored on your device. You are responsible for keeping your own backup using the App's export feature. We are not responsible for content lost due to device loss, deletion, uninstalling the App, or device failure.

 

## 3. Subscriptions, free trial, and billing

 

The App offers an optional auto-renewing subscription ("Daily Planner Pro") with the following terms:

 

- **Free trial:** New subscribers may receive a 3-day free trial. If you do not cancel at least 24 hours before the trial ends, the subscription begins and you will be charged.

- **Price:** $3.99 per month, or $39.99 per year, in U.S. dollars. Prices in other regions are set by the app store and may vary.

- **Auto-renewal:** Subscriptions automatically renew at the end of each period unless auto-renew is turned off at least 24 hours before the end of the current period.

- **Billing:** Payment is charged to your Apple ID or Google Play account at confirmation of purchase, and again at each renewal.

- **Managing and cancelling:** You can manage or cancel your subscription any time in your App Store or Google Play account settings. Deleting the App does not cancel your subscription.

- **Refunds:** Purchases are handled by Apple or Google. Refund requests are subject to their policies; we generally cannot issue refunds directly.

- **Promotional codes:** Free or discounted access may be offered through Apple Offer Codes, Google Play offers, or other promotions we run. Such offers are subject to their stated terms and may be modified or withdrawn.

 

## 4. Acceptable use

 

You agree not to: reverse engineer, decompile, or tamper with the App; use the App for any unlawful purpose; or attempt to circumvent the subscription or access controls.

 

## 5. Not professional advice

 

Daily Planner is an organizational tool. It does not provide legal, financial, tax, employment, or union advice. Records you keep in the App are for your own convenience and are not a substitute for official employer or payroll records. You are responsible for the accuracy of what you enter.

 

## 6. Disclaimers

 

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that data will never be lost.

 

## 7. Limitation of liability

 

To the maximum extent permitted by law, Hospitality is Life LLC (operating as LMR Studios) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or wages, arising out of or related to your use of the App. Our total liability for any claim will not exceed the amount you paid us for the App in the 12 months before the claim.

 

## 8. Changes to the App or Terms

 

We may modify or discontinue the App, or update these Terms, at any time. Continued use after changes take effect constitutes acceptance of the updated Terms.

 

## 9. Termination

 

We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time.

 

## 10. Governing law

 

These Terms are governed by the laws of the State of [Nevada], without regard to its conflict-of-laws rules, and any disputes will be handled in the courts located in [Nevada], unless applicable law requires otherwise.
